 Introduction
 

  1. AXA Health Keeper (the “Platform”) is provided by AXA China Region Insurance Company (Bermuda) Limited (Incorporated in Bermuda with limited liability) and AXA General Insurance Hong Kong Limited(“AXA Hong Kong” or “we” or “us”). This is a health and wellness service platform providing you with lifestyle, health and wellness goods and/or services through a points rewards program.

Registration and Account Security
 

  1. When using the Platform we expect you to help us maintain the security of your account. You acknowledge and agree that:

 

  • You will not invent a false persona, but will use your real identity at all times on the Platform.

 

  • You will not impersonate another person or entity, or otherwise misrepresent your affiliation with another person or

 

  • To the fullest extent permitted under Hong Kong law, you shall keep all information obtained through this Platform secure and

 

  • You are solely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any activity that occurs under or through your account as a result of your failure to keep this information private, secure and confidential. You shall bear the risk of your account being used by any other person for any purpose not authorized by you. AXA Hong Kong is not liable for any loss, damage, cost or other expense incurred by you due to any third party using your account or password as a result of your failure to keep your account information private, secure and

 

  • If you invent a false persona or misrepresent your real identity we reserve the right to disable, delete or suspend your

 

  • If we disable, delete or suspend your account, you agree you will not create another account without our

 
Collection of Health Metrics
 

  1. This Platform will obtain health metrics such as your age, height, weight, step count, sleep data, and fitness workout details from your authorised health tracking devices or your authorized smartphone on which the Platform is installed. Health metrics may be updated from time to

 

  1. The collected health metrics shall be used for your reference and for the purpose of the rewards program to be detailed later (“Rewards Program”) (if applicable) only. This function can only be used in the mobile devices and Health Keeper app owned or controlled by
  2. Your participation in the Rewards Program assumes that you have given your consent that this Platform can have access to the health metrics mentioned above whether stored in your mobile device or your designated health tracking devices in order to be eligible for the Rewards Program. Unless specified otherwise, the data collected by this Platform shall not be used for any other purpose (such as it cannot be used as legal evidence).
  3. AXA Hong Kong does not represent and warrant the accuracy of the journey record and the number of steps recorded. The Reward Program is based on the data collected on AXA Hong Kong’s system and AXA Hong Kong’s decision on the number of steps eligible to the Reward Program is final and non-negotiable.

 
Rewards Program

  1. Fitpoints will be earned under the point system defined by AXA which is based on the activities as stated in the AXA Health Keeper app and website . Activities include profile maintenance and physical activities. Items available for Fitpoint redemption will be based on the acquired level of Fitpoints and the qualifying tiers. The tiers are Beginner, Bronze, Silver and

 

  1. Fitpoints can be redeemed in accordance with the redemption scheme as set out in the AXA Health Keeper app and website. Fitpoints will be valid for a period of 2 years from the date the Fitpoints are credited to your AXA Health Keeper profile. AXA Hong Kong reserve the rights to adjust the point system and your Fitpoints

 

Partner Program

  1. AXA Health Keeper users will be able to access the services of Platform Partners. These Partners will provide services either online or within a clinic or physical location and are subject to availability. Details of Partner Program is listed here (insert URL) and will be updated from time to time. Fees and charges may apply to the Partner

 
 

  1. Rewards Program and Partner Program: AXA Hong Kong reserves the right, at its sole discretion, to do any of the following, at any time, without notice:
  2. amend, modify, add, delete or revise in any way any information of this Program and/or these Terms and Conditions;

 

  1. suspend or terminate the Program, or any portion of the Program, for any reason;
  2. expand, add, modify, reduce, remove or change the Program, or any portion of the Program;
  3. interrupt the operation of the Program, or any portion of the Program, as necessary to perform maintenance, error correction, or other

 

  1. AXA Hong Kong reserves the right to withdraw any rewards under the Reward Program if, in our sole discretion, you have attempted to:-

 

  1. fabricate data for the Reward Program, including but not limited to spoofing and/or any other similar methods;
  2. undermine the fairness, integrity or legitimate operation of the Reward Program in any way by cheating, hacking, deception, or any other unfair playing practices;
  3. use automated system to participate in the Reward Program; or
  4. enter with multiple or fake emails addresses or accounts, use fictitious identities or use any system, bot or other device or artifice to participate in the Reward

  1. You understand that the access to and/or use of the Platform are subject to your acceptance of these Terms and Conditions. As such, by accessing and/or using this Platform, you hereby accept and agree to comply with these Terms and Conditions. If you do not agree to any of these Terms and Conditions, please do not use or access to this Platform.

While AXA Hong Kong has taken reasonable care in providing such information and materials, they are not specific to your investment and/or health training objectives, financial and/or medical situation or particular needs. You have the sole responsibility for adequate protection of mobile phones/access device and back up of data by taking sensible and prudent actions. You are responsible for making all arrangements necessary for you to have access to this Platform via your mobile

We assume no responsibility and shall not be held liable for any loss, damage, cost or other expenses which you may incur as a result of any information or materials provided on this Platform and/or your access to, or the use of, this Platform,.   1. If any provision in these Terms and Conditions is held invalid, the remainder of these Terms and Conditions shall continue to be enforceable. If any provision in these Terms and Conditions is deemed unlawful, void or unenforceable, then that provision is deemed severable from the Terms and Conditions and the remaining provisions are still valid and enforceable.

 

  1. These Term and Conditions shall be governed by the laws of Hong Kong. You and AXA Hong Kong agree to submit to the non-exclusive jurisdiction of the courts of Hong

 

  1. AXA Hong Kong reserves the right, at its sole discretion, to do any of the following, at any time, without notice:
    • amend, modify, add, delete or revise in any way any information of this Platform and/or these Terms and Conditions;
    • determine, impose and vary from time to time the scope and/or any restrictions on the use of this Platform to be made available;
    • suspend or terminate operation of or access to the Platform, or any portion of the Platform, for any reason;
    • expand, add, modify, reduce, remove or change functionalities in the Platform, or any portion of the Platform; and
    • interrupt the operation of the Platform, or any portion of the Platform, as necessary to perform maintenance, error correction, or other

  1. Interfere with, disrupt or violate the Terms and Conditions or servers or networks connected to this Platform; or disobey any requirements, procedures, policies, or regulations of such networks;
  2. Interfere with another individual’s use of this Platform;
  3. Attempt to gain unauthorized access to this Platform, or to other accounts, computer systems, or networks connected to this Platform;
  4. Transmit any file that contains viruses, worms, Trojan horses, or any other contaminating or destructive features;
  5. Use this Platform to conduct any activity or solicit the performance of any illegal activity or other activity that infringes the rights of others;
  6. Resell, barter, trade, auction or otherwise generate income by providing access to this Platform to

Indemnity and Release

You agree to indemnify and must keep indemnified AXA Hong Kong, its related companies and any holding companies from and against any liability, loss, damage, cost or expenses of any kind whatsoever, arising directly or indirectly as a result of or in connection with your non-compliance with these Terms and

 

  1. You will release AXA Hong Kong, its related companies or any holding companies from any and all liability to you in relation to your use of this Platform, including but not limited to any loss of data or purging of

 
Collection of Personal Data
 

  1. AXA Hong Kong applies strict measures to safeguard the confidentiality of personal data. We limit access to your personal data to people working for us on a business need to know basis who shall ensure that your personal data are protected against unauthorized or accidental access, processing, erasure, loss or use. We store information under a secure site with 128-bit encryption. Personal data to and from AXA Hong Kong is encrypted through the Secure Socket Layer (SSL)

 
Purpose

  1. From time to time it is necessary for AXA Hong Kong to collect your personal data which may be used, stored, processed, transferred, disclosed or shared by us for purposes (“Purposes”), including:

 

  1. offering, providing and marketing to you the products/services of AXA Hong Kong, other companies of the AXA Group (“our affiliates”) or our business partners (see “Use and

provision of personal data in direct marketing” below), and administering, maintaining,
managing and operating such products/services;

  1. any agent, contractor or third party who provides administrative, technology or other services (including direct marketing services) to AXA Hong Kong and/or our affiliates in Hong Kong or elsewhere and who has a duty of confidentiality to the same;

 

  1. credit reference agencies or, in the event of default, debt collection agencies;

 

  1. any actual or proposed assignee, transferee, participant or sub-participant of our rights or business; and

 

  1. any government department or other appropriate governmental or regulatory authority in Hong Kong or

Use and provision of personal data in direct marketing

  1. use your name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data held by AXA Hong Kong from time to time for direct marketing;

 

  1. conduct direct marketing (including but not limited to providing reward, loyalty or privileges programmes) in relation to the following classes of products and services that AXA Hong Kong, our affiliates, our co-branding partners and our business partners may offer:

 

  1. insurance, banking, provident fund or scheme, financial services, securities and related products and services;

 
 

  1. products and services on health, wellness and medical, food and beverage, sporting activities and membership, entertainment, spa and similar relaxation activities, travel and transportation, household, apparel, education, social networking, media and high-end consumer products;

 
 

  1. the above products and services may be provided by AXA Hong Kong and/or:

 

  1. any of our affiliates;

 

  1. third party financial institutions;

 

  1. the business partners or co-branding partners of AXA Hong Kong and/or affiliates providing the products and services set out in 2 above;

 

  1. third party reward, loyalty or privileges programme providers supporting AXA Hong Kong or any of the above listed entities;;

 
 

  1. in addition to marketing the above products and services, AXA Hong Kong also intends to provide the data described in 1 above to all or any of the persons described in 3 above for use by them in marketing those products and services, and AXA Hong Kong requires your written consent (which includes an indication of no objection) for that purpose

 
 
Before using your personal data for the purposes and providing to the transferees set out above, AXA Hong Kong must obtain your written consent, and only after having obtained such written consent, may use and provide your personal data for any promotional or marketing purpose.
